Arkansas AG announces settlement with Walmart

Arkansas Attorney General Tim Griffin announced a settlement with Walmart in light of a lawsuit filed by the Federal Trade Commission and 11 other states for deceptive trade practices.

The civil suit targeted unfair practices in Walmart’s Spark Driver program, which misrepresented compensation and tip amounts to drivers before they accepted a job; reduced pay after delivery; misrepresented batching orders or splitting tips; telling consumers that drivers received 100% of tips; and failed to pay driver-incentive bonuses.

“This is a victory for consumers and working Arkansans, and I am pleased to see this issue resolved,” said Arkansas Attorney General Tim Griffin. Arkansas was not part of the original lawsuit but reached a subsequent settlement with identical terms, resulting in Walmart paying $847,847 in civil penalties to the state.

Monetary relief for affected Arkansas drivers was provided as part of the consent judgment in the FTC suit. Arkansas’ settlement ensures additional accountability and civil penalties for conduct affecting drivers in the state, Griffin’s office said.
