The following names and charges, which are contained within public documents, are gathered from online court records available through ARCourts. Defendants are presumed innocent until proven guilty. Here’s a rundown of felony cases filed in the past two weeks:
Chicken house burglar caught on camera
An Amity man could be cooped up in a prison cell for a few years after he was caught in a chicken house where he wasn’t invited.
On July 2, Clark County deputies were sent to a poultry home on Nutt Road for a complaint of trespassers on the property. By the time law enforcement arrived, the unwelcome guests had already winged it. However, camera surveillance of the property led Amity Police Chief Garry “B.J.” Johns to promptly identify Gene McKinnleyd Tigue, 35, of Amity, based on his face and tattoos.
The surveillance system reportedly showed the suspect take one of the cameras.
Police caught up with Tigue to make an arrest on Aug. 21. Bond was set at $50,000 during a first court appearance held Aug. 24.
Tigue was formally charged with Breaking or Entering, a Class D felony, as well as misdemeanor Theft of Property and Criminal Trespass.
Gurdon man accused of tossing fentanyl out window during DWI arrest
Arkansas State Police are accusing a Gurdon man of throwing a baggie of fentanyl to the highway shoulder during a traffic stop.
On the afternoon of July 29, 54-year-old Jeffrey Troxel was driving a pickup truck on US Highway 67 when a trooper reportedly observed him cross into the oncoming lane of traffic and swerving in his own lane.
During a traffic stop, the trooper noticed the smell of alcohol on Troxey’s person and inquired whether he’d been drinking. Troxel replied that he’d only drank a jar of pickle juice, but ultimately admitted to consuming alcohol. A field breathalyzer showed him to be over the limit, and he was arrested and taken to the county jail, where he refused a chemical test.
After reviewing video footage of the traffic stop, troopers reportedly observed Troxel throw a baggie out of the passenger window. A trooper went to the scene and reportedly located a bag containing a white crystallized substance, and stored it as evidence. The substance was originally thought to be methamphetamine; however, Troxel is formally charged with Possession of Fentanyl, a Class C felony, in addition other the misdemeanor DWI charge.
His bond was set at $5,000 during a first court appearance on July 31.
30 counts of child porn for Gurdon man
Formal charges have been filed against a Gurdon man we previously reported was arrested for possessing child pornography.
Ivie Little Harris, 44, has been charged with 30 counts of Pandering or Possessing Visual or Print Medium Depicting Sexually Explicit Conduct Involving a Child, each a Class C felony.
Given Harris’s status as a habitual offender convicted of four or more felony offenses, prosecutors are seeking a sentence enhancement. With the enhancement, Harris could face 3-30 years in prison for each charge if he’s convicted.
Following his arrest, bond was set at $200,000 during a first court appearance held Sept. 2.
Amity man arrested for threats with sawed-off shotgun
A hot-headed Amity man is accused of brandishing of sawed-off shotgun and a Samurai sword at his nemesis.
Jerry Dale Ness, 58, was arrested Sept. 13 following a heated exchange with another man, who rang police when an intoxicated Ness reportedly walked onto his porch and made death threats with the firearm, a Samurai-type sword, and knives.
A deputy arrived and spoke with an unarmed Ness, who explained that he had been in an argument with the caller. A police affidavit doesn’t say what the argument entailed. While the deputy spoke with Ness, he turned and punched the caller’s vehicle, leaving a dent in the body that would need repairing.
Ness refused to surrender to arrest, instead attempting to flee on foot before another deputy at the scene promptly took him to the ground and made the arrest.
The caller then invited the deputies inside, where they located the loaded weapon in question, as well as ammunition matching a shell Ness held in his hand at the time of his arrest.
Police note that Ness has an “extremely lengthy” criminal history of violence, with past convictions of felony offenses that prohibit him from possessing a firearm.
Bond was set at $75,000 during a first court appearance held Sept. 16.
Ness has been charged with Possession of a Firearm by a Certain Person, a Class B felony, as well as Class D felonies Terroristic Threatening, Aggravated Assault, Criminal Use of a Prohibited Weapon and Possession of a Defaced Firearm. Prosecutors are seeking sentence enhancements on each charge given Ness’s status as a habitual offender.
