A Clark County couple’s lawsuit against the City of Arkadelphia is headed back to a lower court after the Arkansas Court of Appeals remanded parts of an appeal by the city
The lawsuit, filed by the City of Gurdon, claims that Suddenlink has failed to pay proper franchise fees for its use of city rights-of-way and has failed to meet the required minimum service requirements for city cable customers
The ruling means that Suddenlink, which now does business as Optimum, will not be able to avoid the claims of the Arkansas cities where it provides services through franchise agreements
