State vs. Joshua Wesley Rutherford. Sex Offender Failure or Refusal to Provide Information, Habitual – Class C felony; Registered Sex Offender Residing Within 2,000 Feet of Certain Property, Habitual – Class D felony. Prosecutor: Gina White. Defense: Clint Mathis. Rutherford, a Level 3 sex offender registered under the jurisdiction of the Clark County Sheriff’s Office, reported himself as homeless on May 9 after being kicked out of his registered residence in Beirne. However, based on data collected from an ankle monitor, in the days after reporting himself homeless, the 42-year-old Rutherford was residing at a South 27th Street address in Arkadelphia, within 2,000 feet of a licensed daycare center, according to an affidavit filed by Sgt. Sherry Cleek of the CCSO.
