New state law requires photo ID to record deeds

The Clark County Circuit Clerk’s Office reminds citizens of a new state law requiring a government-issued photo ID in order to file a deed in person or by mail beginning next month. 

Act 752, passed by the Arkansas General Assembly, becomes effective Aug. 5, 2025, and requires a deed recorded with the county recorder in person be presented for recording by a grantor named in the deed or an individual who signed the deed on behalf of a grantor.

The grantor or person who signed on his/her behalf must provide either a photo ID or a driver’s license if recording in person. They may also enclose a photocopy of a valid ID if recording by mail.

Deeds recorded in person or by mail that aren’t accompanied by ID will be rejected. The requirement does not apply to deed that are electronically recorded through the county’s e-recording system or deeds recorded by an attorney, real estate broker or agent, bank representative, mortgage company or lending institution, title insurance agent, Commissioner of State Lands, a person representing the state or political subdivision of the state, or the state or an Arkansas municipality.
